CONDITIONS OF ACCEPTANCE |

| 1. | All lots to be sold subject to the Auctioneers' Condition of Sale. | ||
| 2. | Lotting up shall be decided by the Auctioneers at their sole discretion. | ||
| 3. | All lots will be sold without reserve unless a reserve is agreed and entered on the Schedule or confirmed in writing prior to Auction. | ||
| 4. | The Auctioneers may deduct commission and other agreed charges from the proceeds of sale before accounting to the seller. Please see Condition 11 re photography charges. | ||
| 5. | Vendor's Commission will be charged on the sale price of individual lots as follows: | ||
| On the gross amount realised up to £25,000 | 11.75% |

| Lots failing to sell | £5.00 | ||
| Lots withdrawn | normal commission | ||
| Insurance charged | 1% | ||
| over £25,000 or large collections | special agreed commission rate. | ||
| or such other rate
which may have been negotiated and agreed in writing by the Auctioneers prior to sale. There is a minimum charge of £5 per lot. The Auctioneers reserve the right to charge the Buyer a premium at the current rate. |

| 6. | The Auctioneers will insure goods in their care against Fire, Burglary, Water damage and Accidental Damage at a cost to the Seller of 1% of value cover or part thereof . Goods will be insured for the Auctioneers' estimate or their actual sale price as the case may be. | ||
| 7. | The Seller shall be bound by all actions taken by the Auctioneers pursuant to the Conditions of Sale in respect of the sale or rescission of sale of any lots or settlement of any claim by any buyer. | ||
| 8. | The Auctioneers may refuse to offer for sale items which they consider unsaleable and may dispose of the same without notice to the Seller and may charge the Seller a disposal charge to cover expenses. | ||
| 9. | Provided they shall have acted in good faith the Auctioneers shall not be liable to the Seller where the sale has been rescinded or a claim by a buyer settled by the Auctioneers pursuant to the Conditions of Sale or where any other claim is brought by a buyer in consequence of any misdescription by the Auctioneers. | ||
| 10. | The Seller warrants good title to goods offered for auction free of any bill of sale, hire purchase or leasing agreement or any other third party rights and will indemnify the Auctioneers against all claims brought against them in consequence of any defect in the Seller's title to lots sold. | ||
| 11. | Where the Auctioneers are of the opinion that certain items will benefit by press and/or catalogue illustrations, such photographs will be charged at the current rate (currently £2.50/£5.00 per small / large lot). | ||
